Albumer is a photo album app and website that lets you keep your photos in one place and share albums privately with the people you choose. It is made by DOR Industries.

These terms are the agreement between you and DOR Industries ("Albumer", "we", "us") covering the Albumer apps for iPhone and Android, albumer.com, and everything we provide through them. By creating an account or using Albumer you agree to them. If you don't agree, please don't use Albumer.

Your account

You need an account to use Albumer, you must be at least 13, and the details you give us should be accurate. Keep your password to yourself — you're responsible for what happens on your account. Tell us at albumerapp2@gmail.com if you think someone else has got into it.

Your photos are yours

You own your photos, videos and everything else you put into Albumer. Uploading them to Albumer does not give us ownership of them and never will.

So that we can actually run the service, you give us a narrow permission to store your content, back it up, and show it to you and to the people you have chosen to share an album with — including resizing it, making thumbnails, and sending it to a photo frame or print order when you ask us to. That permission exists only to operate Albumer for you, and it ends when you delete the content or your account.

We do not sell your photos, license them to anyone else, use them to advertise Albumer, or use them to train artificial-intelligence models. If we ever want to show something of yours publicly — in an app store screenshot, say — we will ask you first and you can say no.

Albums you share are visible to the people you invite, and members of a shared album can add their own photos to it. Think about who you invite before you share.

Acceptable Use — Community Rules

Albumer lets you create photo albums and share them with people you invite. Those albums can hold photos of your family and your children, so the rules below are not negotiable. They apply to everything you upload, to album and folder names, to comments and voice notes, and to the people you invite.

You may not upload, share or store:

• Any sexual content involving a minor. This includes photographs, video, drawings and any attempt to solicit such material. There are no exceptions and no warnings.
• Sexually explicit or pornographic material of any kind.
• Photographs of any person taken or shared without their knowledge or consent, including intimate images shared without consent.
• Content that threatens, harasses, bullies, stalks or intimidates another person.
• Content that attacks or degrades people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation, or that promotes a violent or hateful organisation.
• Graphic violence, cruelty to people or animals, or content that promotes self-harm, suicide or eating disorders.
• Content that promotes illegal activity, including the sale of drugs, weapons, stolen goods or trafficking of any kind.
• Photographs you do not have the right to share, including copyrighted work belonging to someone else.
• Spam, scams, phishing, malware, or bulk unsolicited invitations.

You also agree not to: attempt to access albums you have not been invited to, interfere with or probe the service or its security, use automated tools to scrape or bulk-download content, resell access to Albumer, or impersonate another person.

Children

Albumer is not intended for children under 13, and you may not create an account if you are under 13. Parents and guardians are welcome to create albums about their own children; if you do, you are responsible for the photos you upload and for who you invite to see them.

Reporting content

Every photo, album and comment in Albumer can be reported from inside the app: press and hold a photo and choose Report, or tap the flag beside a comment. You can block the person at the same time, which hides their content from you and stops them sharing anything with you again.

We review every report, normally within 24 hours. You can also email us directly at albumerapp2@gmail.com. If you believe someone is in immediate danger, contact your local emergency services first.

Child sexual abuse material

We have zero tolerance for child sexual abuse material. When we become aware of it we preserve the content and the account records, report it to the National Center for Missing & Exploited Children (NCMEC) as required by law, remove the content, and permanently ban the account. We cooperate fully with law enforcement. This applies to private albums and to Secret Albums exactly as it applies to anything else.

What happens if you break these rules

Depending on what has happened, we may remove the content, restrict what your account can do, suspend it, or permanently close it and delete its contents — and we may do any of these without notice where the content is illegal or someone is at risk. Serious violations are reported to the relevant authorities.

If you think we have got it wrong, email albumerapp2@gmail.com and a person will look at it again.

Copyright complaints

If you believe your copyrighted work has been uploaded to Albumer without permission, email albumerapp2@gmail.com with a description of the work, where it appears in Albumer, your contact details, and a statement that you are the rights holder or authorised to act for them. Accounts that repeatedly infringe are closed.

Free accounts, storage and subscriptions

Albumer has a free plan with a set amount of storage, and a paid plan (Albumer Premium) with more storage and extra features. Current storage limits and prices are shown in the app before you buy. If you go over your storage limit you can still see and share everything you already have — you just can't add more until you free up space or upgrade.

Subscriptions bought in the app are billed by Apple or Google, not by us. They renew automatically at the then-current price until you cancel, and you cancel through your Apple or Google account settings — not by emailing us and not by deleting your Albumer account. Deleting your account does not stop a subscription. Refunds are handled under Apple's or Google's policies; we'll help where we can, but we can't refund a payment we never received.

If we change prices we'll tell you before the change affects you, and you can cancel.

Deleting your account

You can delete your Albumer account at any time, from inside the app (Profile › Delete My Account) or at albumer.com/account-deletion. This permanently deletes your albums, folders, photos and contacts, and the files behind them. It cannot be undone and we cannot recover them afterwards, so save anything you want to keep first.

Albums other people shared with you aren't deleted — you simply lose access. Photos you added to someone else's album stay in that album. Remember to cancel any subscription separately.

Privacy

How we handle your personal information is set out in our Privacy Policy. Albumer and the site use cookies and similar technology to keep you signed in and to make the service work.

Our intellectual property

The Albumer name, logo, apps, website, design and software are ours. You may use them to use Albumer as intended; you may not copy, resell, reverse-engineer or redistribute them, or use our name or branding without our written permission. This doesn't affect your ownership of your own photos.

Availability of the service

We work hard to keep Albumer running and your photos safe, but we can't promise the service will always be available or completely free of faults, and we may change or discontinue features. We back up your content, but Albumer is not a substitute for your own backup — please keep your own copies of photos that matter to you.

Except for what we've promised in these terms, Albumer is provided "as is" and we don't make other warranties about it, to the extent the law allows.

Limitation of liability

Nothing in these terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential losses, or for lost profits or lost business. For everything else, our total liability to you in any 12-month period is limited to the amount you paid us for Albumer in that period, or US$100 if you're on the free plan.

Changes to these terms

We may update these terms as Albumer changes. If a change matters to you we'll give you reasonable notice in the app or by email before it takes effect. Carrying on using Albumer after that means you accept the updated terms; if you don't, you can delete your account.

Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules, and the courts of Maricopa County, Arizona will have jurisdiction over any dispute. If you're a consumer somewhere else, this doesn't take away rights you have under the mandatory laws of the country you live in.

If any part of these terms turns out to be unenforceable, the rest still applies.
